Introduction

Welcome to Scouty, a two-way marketplace and training platform connecting health and fitness coaches and professionals ("Coaches") with people seeking fitness, health and wellness support ("Clients"). We value your privacy and are committed to protecting your personal information.

This Privacy Policy explains what personal data we collect, how we use and share it, and your rights regarding that data. It applies when you use the Scouty website, mobile application, and any related services (collectively, the "Platform"), whether you are a Coach, Client, or visitor. By using Scouty, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Platform.

Our commitment: You can rely on us to handle your personal data in accordance with applicable privacy laws, including the New Zealand Privacy Act 2020, the Australian Privacy Act 1988 (and Australian Privacy Principles), the UK Data Protection Act 2018 and EU General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA) as amended by the CPRA. We will update this policy as needed to remain compliant with new regulations and to reflect any changes in how Scouty operates.

Personal Data We Collect

We collect various categories of personal information from Coaches and Clients to provide and improve our services. The types of data we collect include:

1. Information You Provide to Us

Account Registration: When you create an account as a Client or Coach, we collect information such as your name, email address, language, phone number, date of birth, gender, city, country of residence, post code and a password.

Profile Information (Coaches): Coaches may provide additional profile details, including business name, professional certifications, qualifications, areas of expertise, personality type, services and products offered including pricing information, addresses for locations (such as city/region) they coach in, years of experience, photos and videos (e.g. profile picture, logo and YouTube links), a biography/description, social media links or handles, other software you may use, and your availability. Coaches might also include other personal and business details relevant to coaching services including training plans, programmes, blogs and availability schedules.

Profile Information (Clients): Clients may provide additional information such as fitness and wellness goals, personality type, personal fitness and health metrics, medical information relevant to training (e.g. injuries, nutritional data, conditions, activity level), location, country, post code (for finding local coaches or time zone purposes), and any preferences or goals. Clients can upload photos, videos or other information (for example, progress photos or notes) at their discretion. We may also collect information regarding your business, including the size and type of business.

Communication and Content: If you communicate with Coaches/Clients through our Platform (for example, messaging or email via the Platform), or if you post content such as reviews, success stories, or other contributions, we collect those communications and any information you choose to share. This includes any feedback, testimonials, media (e.g. photos, videos) or success stories you volunteer.

Transactions and Payment Information: When Clients purchase coaching sessions/programs or Coaches pay subscription fees, payments are processed via our third-party payment processor Stripe. You will provide payment details such as credit card information or bank details directly to Stripe through the Platform's interface. Important: Scouty itself does not receive or store your full financial account details (such as full credit card numbers); that information is handled securely by Stripe. We do keep basic transaction records, such as the date/time of transactions, the amount, and the involved parties (Coach/Client). Coaches may also provide payout information (like bank account details or Stripe account ID) to receive payments, which is likewise handled via the payment processor.

Personal information of others

If you provide us with Personal Information relating to a third party you warrant you are authorised to do so and that you have ensured the individual is aware of the information in this Policy. If you provide us with Personal Information about others, or if others give us your information in relation to any purchase or usage of the Platform then it will be used as set out in this Policy.

Social Media and third party websites

We use social media sites including Facebook, Twitter, YouTube, Reddit, TikTok and Instagram. Anything you post on these sites, or third party websites is available for others to see.

We may use information you have shared on these platforms for different purposes such as sharing content, reviews and gaining insight. Where legally required we will seek your permission to share or use this data.

Where the functionality of our websites or other services that allow you to login using your information from social media platforms such as Facebook, Gmail, Apple etc. you authorise us to disclose your login information such as your name and email address to the social media platform to enable the platform to verify your details. You authorise us to collect and use such verification information to provide you access to services and as otherwise set out in this Policy.

Referrals and Sharing

If Scouty offers a referral feature where you can invite friends to join, and you use it, we may collect your friend's email address or contact number to send them an invitation. We will only use that information for the specific purpose of sending the invite. By providing a friend's contact details, please ensure you have their permission. If you share content from Scouty through social media or messaging services (for example, sharing a coach's profile via Facebook or WhatsApp), that action may involve another service receiving some data (like the content link and your account name on that service). We don't receive the details of your social account from that sharing action, but be aware that the third-party platform will handle your data according to its own terms.

Other Users of Scouty

We might receive information about you from other users as part of the platform's normal operation. For example, a client might leave a review or rating on a coach's profile, which includes information about their experience. If you are a coach, you could receive feedback that we store and display on your profile. Conversely, a coach might provide information about their interactions with a client (such as notes or a rating). We consider this part of your personal data on the platform. We use it to maintain trust and transparency (for example, showing reviews), and as necessary to mediate disputes or improve our services.

Additional Information we collect

If you participate in surveys, promotions, or marketing events, or if you contact customer support, we will collect the information you provide (such as survey responses or support inquiries). This data may be personally identifiable.

We also collect any information you submit when filling in forms on the Platform or in our marketing and customer service activity (for example, when signing up for newsletters, email us or completing your profile).

Information collected by us from social media accounts used to access Scouty services

We collect your Personal Information when you provide it to us (including creating an account), when you enter one of our competitions, when you contact us, or when you purchase our products or services. We also collect your Personal Information when you interact with the marketing communications we send you and through your use of our services.

Our website may also state other ways in which we collect information from you.

If you access our website from outside of New Zealand, you agree that any Personal Information you provide us is subject to this Policy.

Information We Collect Automatically

When you use Scouty, we automatically collect certain information about your device and how you interact with our app or website. This data helps us ensure the platform works correctly, allows us to personalise your experience, and aids us in improving our services. The information we collect automatically includes:

Device and Technical Information: We collect details about the device and app you use to access Scouty. For example, we may collect data such as your device type, operating system and version, unique device identifiers or advertising IDs (like Apple's Identifier for Advertisers (IDFA) or Google's Advertising ID on your device), the Scouty app version or website browser version, and language and region settings on your device. We also log the time and date you access our services and what features or pages you use.

Usage Data: We monitor how you use Scouty so we can understand and improve the platform. This includes things like the pages or screens you view, the features you tap or click on, the search queries you make, the bookings or listings you interact with, and other actions (for example, how many times you open the app, or how often you message others). We collect information around products, services or subscriptions purchased or added to cart on the Platform. We also collect standard log information such as your device's Internet Protocol (IP) address.

Cookies and Similar Technologies: We use cookies, pixels, and other tracking technologies on our website and app to collect information about your browsing and usage activities automatically. Cookies are small text files placed on your device that help us recognise you and remember your preferences. For example, we might use a cookie to keep you logged in or to remember your preferred language, so you don't have to re-enter these each time. We also use cookies and similar tools for analytics (to see how many users visit certain pages and for how long) and for advertising purposes (to help deliver relevant ads about Scouty on other platforms, as explained in Cookies and Tracking Technologies below). The information these technologies collect may include your browser type, device model, browsing actions on our site, and approximate location (based on your IP address). Example: If you visit our website and adjust your settings, we might store a cookie so that on your next visit we can recall those settings, making your experience smoother.

Location Information: We may collect location data from your device and your IP address. Collecting your IP address can help us serve more relevant information to you. We may also ask if you want to allow location access when you first install or open the Scouty mobile app. If you grant access via your device settings or the app settings, Scouty can use your device's GPS or other location methods to determine where you are. We use this to provide location-specific features, such as showing you coaches or opportunities near you. You can choose whether to allow location sharing on your app. You can also adjust your choice later via your device's privacy settings or in-app settings.

App Permissions and Functionality: Similarly, the app may request permission to use certain device functions, such as push notifications or your camera/photos. We will ask for your consent before accessing these. For example, if you want to upload a profile picture or share a photo (such as a location image or a certificate) on Scouty, our app will ask for access to your camera or photo library. If you allow it, you can upload images; if not, you can still use Scouty to an extent but without those images. Likewise, when you first log in or on your account detail page we may ask if you want to enable push notifications. If you agree, we may send you notifications in the app or on your device about important activities — for instance, a notification when a client sends you a new message or when a coach accepts your booking request. You can choose which notifications you want to receive and you can turn them off anytime through your device or in-app settings and via your Scouty account page.

Crash and Error Reports: If the Scouty app or website encounters an error or crashes, we might automatically collect a crash report. This report includes technical information about the error (like which part of the code had an issue, device model, and conditions leading to the crash). These reports help us diagnose and fix problems to make Scouty more stable. We process error reports under our legitimate interest in maintaining a reliable and secure service - they are used strictly for debugging and improving quality.

Analytics Data: We use analytics tools (e.g. Google Analytics) that automatically collect data about your interactions with Scouty. This data is often aggregated and anonymised. It helps us answer questions like, "Which features are most popular?" or "How do users navigate through the app?" These tools may use cookies or device identifiers to help track usage patterns.

Information from Third Parties

Sometimes we receive information about you from other sources. The amount and type of information may vary depending on the source, but typically it falls into these scenarios:

Third-Party Logins: If you choose to log in or sign up via a third-party platform (for example, using "Sign in with Google" or "Continue with Facebook"), that platform will share certain personal information with us, but only after you consent to such sharing. Typically, this includes your name, email address, and possibly a profile photo from your third-party account. We use this information to create or log you into your Scouty account.

Payment and App Store Providers: As noted, if you make purchases through Scouty, our payment processor Stripe will send us information to confirm the transaction. Similarly, if you downloaded the Scouty app from an app store like Apple App Store or Google Play, we may receive certain technical and purchase-related information from that store.

We will always handle information from third parties according to this Privacy Policy.

Note: Coaches are independent professionals. Any personal data you share directly with a Coach or a Client outside of the Platform (for example, in person or via a third-party app) is not governed by this Privacy Policy. However, our Terms require Scouty users to use personal information only for providing services through Scouty. We strongly encourage both Coaches and Clients to keep all communications and data sharing on the Platform where possible, so that it remains subject to Scouty's privacy and security protections.

4. Sensitive Personal Data

In the context of fitness, health and wellness services, you may provide sensitive personal data such as health information (e.g. medical conditions, injuries, mental or physical health status) or demographic details like racial/ethnic origin or sexual orientation if relevant to your training needs. Any health or sensitive information you do choose to share with us (or with your Coach or Client through the Platform) will be used for the purpose of providing Scouty services and supporting your wellness journey. By providing such information, you consent to our processing of this sensitive data for the purposes described in this Policy.

Children's Privacy: The Scouty Platform is not intended for individuals under the age of 16. We do not knowingly collect personal information from children under 16. If we become aware that a child under 16 has provided us with personal data, we will take steps to delete such information. (If you are a parent or guardian and believe your child has provided personal information to us, please contact us at support@scouty.co.nz.)

How We Use Your Personal Data

We use the personal data we collect for the following purposes and in accordance with the NZ Privacy Act. Generally, we will use your data to operate our Platform, provide our services, communicate with you, improve and market our services, and fulfill our legal obligations. Here are the specific purposes for which Scouty uses personal information:

Providing and Operating the Platform: We use your data to create and maintain your account, enable the marketplace and service provision functionality, enable coaches and clients to schedule, purchase, manage, prescribe, track metrics that support training and fitness, health or wellness goals and allow you to use our features. Client information is shared with their chosen Coach (and vice versa) to enable scheduling of sessions, delivery of coaching plans, tracking progress, and other interactions.

Customer Support: We process personal data when you reach out to us for assistance or to report an issue. This includes using your contact information and the content of your inquiries to respond to you, troubleshoot issues, and improve your experience. For instance, if you email our support, we will use your email address and any information you provide about the problem to help resolve it.

Personalisation and User Experience: We may use information such as your location, browsing behavior, or past interactions, bookings, searches and purchases to personalise the content you see on our Platform. For example, we might highlight coaches near your area, suggest relevant wellness content, or pre-fill certain fields to streamline your experience. Personalisation helps make the Platform more useful to you.

Analytics and Product Improvement: We use data to understand how our users interact with Scouty. This helps us analyse trends, track the effectiveness of Platform features, and identify areas for improvement. We may also perform market research, such as sending identifiable user surveys or analysing industry trends, to better tailor our services to client and coach needs.

Marketing and Promotional Communications:

  • We may use your contact information to send and show you promotional material about new features, products, services, newsletters, offers, or other news about Scouty and our partners. These may include recommendations and suggestions, and may be delivered through our websites, apps and, if you have consented, via email, SMS, WhatsApp, or browser notifications, or SMS.
  • We may use your information to highlight success stories or testimonials. For example, if a Client achieves a noteworthy wellness goal with the help of a Coach, we might ask for permission to feature that story on our website or social media. Any such use of an identifiable personal story would only be done with the individuals or businesses explicit consent. Coaches' business success stories or profiles may also be showcased in our marketing (again, with consent).
  • We may use your information to administer referral programmes, rewards, marketing surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by us or our business partners or notify you when products are available to purchase.
  • We may use your information to measure the effectiveness of our advertising and make improvements.

Email and SMS Engagement: Beyond marketing, we also use your contact information to send essential account or transaction-related messages. This includes booking confirmations, reminders for upcoming sessions, notifications of messages from your Coach/Client, verification codes, password reset emails, changes to terms or policies, and other administrative or service-related communications. These communications are considered part of our service to you.

Advertising and Retargeting:

  • We may use data about you to serve you targeted advertisements about Scouty on third-party platforms (such as Google, Facebook/Instagram, TikTok, or other ad networks). For instance, we might use cookies or pixels to know which pages you visited on our site, and then show you ads on other platforms encouraging you to sign up or return to the Platform. We might also use your email address or phone number to create "custom audiences" on platforms like Meta (Facebook, Instagram) or Google. This allows us to show ads to existing users or find similar users on those platforms.
  • To find audiences of people with similar interests to you to show digital ads on Facebook, Instagram and Google
  • You can control the ads you see off-site in various ways, for example through Google's Ad Settings, through your Meta Adverts settings, by visiting the websites of the Network Advertising Initiative or Digital Advertising Alliance or through your browser settings.

Safety, Security and Fraud Prevention: We are dedicated to keeping Scouty safe and secure. We may process personal data to monitor for suspicious activity, enforce our Terms and community guidelines, and verify user identities where necessary. For example, we might use automated tools to detect fraudulent transactions or use of the Platform, or manually review certain activities if flagged. If necessary, we will use information about misuse of the Platform to take action, such as investigating and communicating with users involved or reporting to authorities if required.

Legal Compliance and Legitimate Business Interests: We may need to use certain personal information to comply with legal obligations such as tax, insurance, payment and accounting requirements, responding to legally binding requests from law enforcement, or keeping records of consents. Additionally, we use and retain data as needed for legitimate business purposes such as protecting our legal rights (for example, to enforce our contracts and terms, to handle any legal claims or disputes), performing audits and financial control. We may use your data to take any action in any case of dispute, or legal proceeding of any kind between you and us, or between you and any other person with respect to our business.

Legal Bases for Processing (EEA/UK users): If you are located in the European Economic Area or United Kingdom, we must inform you of the legal grounds on which we process your personal data under the GDPR/UK GDPR. We process personal data on the following bases: (a) as necessary to perform our contract with you (providing the Scouty services such as connecting Coaches and Clients, processing payments, and customer support); (b) as necessary to comply with our legal obligations; (c) for our legitimate interests in operating and improving our Platform and business (for example, improving services, preventing fraud, marketing to you, provided these interests are not overridden by your data protection rights); and (d) in some cases, based on your consent (for instance, where we ask for your consent to send marketing emails, texts, or to process health information, or to use certain cookies).

Use of Artificial Intelligence (AI)

Scouty uses Artificial Intelligence ("AI") and machine learning technologies to improve your experience on the Platform and improve our efficiencies as a business. This includes processing personal data for analysis and optimising the platform.

Where AI tools process personal data, Scouty ensures this is under the setting of "disable model improvement" to avoid personal or sensitive data becoming discoverable.

We do not conduct fully automated decision-making that produces legal effects concerning you or similarly significantly affects you without human review, as described in Article 22 of the GDPR

How We Share Your Personal Data

We do not sell your personal information to third parties. However, we do share certain categories of data with third parties for the business purpose of operating Scouty and delivering our services to you.

We may also transfer Personal Information to third parties to perform services on our behalf, for example we transfer your Personal Information to our payment provider, to process in accordance with the Act NZ Privacy Act 2020.

We may also transfer Personal Information to other third parties (including technology providers, providers of business and marketing services and providers of software tools used by us in our business) to perform services on our behalf and to process the information for us. We do not permit such parties to use the information for their own purposes.

The types of organisations and scenarios in which we share data are as follows:

Sharing with Other Users (Coaches and Clients): Our Platform is designed to facilitate connections between Coaches and Clients. This means that information will be shared between users when necessary. If you are a Client, when you engage with a Coach (for example, sending a message, booking a session, or enrolling in a programme), the Coach will be able to see certain personal information about you. This typically includes your name, the information you have provided in your profile (such as age, gender, general location, fitness goals), and any health or personal details you have chosen to share for training purposes. Coaches will also see any content you directly share with them (like messages, photos or posted progress metrics). If you are a Coach, your public profile information (name, photos, pricing, location, credentials, social links, etc.) will be visible to Clients and visitors on the Platform. Clients who book or communicate with you will also see additional information you choose to share (for example, a customised training plan or notes you provide to that client). Please note: Both Coaches and Clients must only use any personal information they learn about each other solely for the purposes of using the services on Scouty. Misuse of another user's personal data is a violation of our Terms. Please be cautious about what personal details you share in your communications.

Service Providers and Vendors: We share personal data with trusted third-party service providers who help us run our business and the Platform. These companies perform services on our behalf and need access to certain information to do so. They include:

Payment Processors: As noted, we use Stripe to process all payments on Scouty. Stripe will receive necessary personal information to charge or pay you, such as your name, card, account details, billing address and transaction amount. Stripe processes this information in accordance with its own privacy policy and is contractually bound to handle your data securely and only for the purposes of providing payment services. Scouty itself does not store your sensitive payment details (like full credit card numbers).

Email, Whatsapp and SMS Platforms: We may use email service providers (for example SendGrid, Mailchimp, or similar) to send out newsletters, notifications, and marketing communications. Similarly, we might use SMS gateways or communication APIs (for example, Twilio or equivalent) to send text, Whatsapp messages, app or push notifications. These providers will process your contact information and message contents as needed to deliver communications on our behalf. Scouty may change who our service providers are at its sole discretion and at any time. We will not be able to provide surveys or marketing communications to you if you unsubscribe or do not agree to our use of third parties to assist us with our surveys or marketing communications. Where you sign up to receive surveys or marketing communications from us, you agree that we may disclose your Personal Information to those third parties as set out in this Privacy Policy.

Cloud Storage and IT Infrastructure: Scouty is a cloud-based platform. We use third-party hosting and cloud infrastructure services such as Amazon Web Services (AWS) to store and manage our data securely. Your personal data is stored on these cloud servers and may therefore be processed in various data center locations.

Analytics Services: We use third-party analytics tools like Google Analytics to collect information about how users use our Platform. These tools set their own cookies or identifiers to gather usage data (e.g., pages visited, time on site, referring site, and other web analytics). We use the insights from analytics to improve our service and marketing efforts. Google Analytics may utilise the data collected to track and examine the use of our Platform and to prepare reports on its activities.

Advertising Partners: We may partner with advertising networks, agencies and social media platforms to promote Scouty. As part of this, we might share personal data or allow collection of data via cookies/pixels. For example, we use the Google Ads network, Facebook/Meta Ads, and TikTok Ads. These platforms may receive information to help us target ads or exclude people from seeing irrelevant ads. You can opt out of most interest-based advertising as explained in the Cookies and Tracking section.

Business Transfers: If Scouty is involved in a merger, acquisition, financing due diligence, reorganisation, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your personal data may be transferred as part of that transaction. Any new owner or successor entity will be bound by terms that are consistent with this Privacy Policy in how they handle your information. You would also be notified via the Platform or email if such a transfer occurs, along with any choices you may have.

Law Enforcement and Legal Requirements: We may disclose personal information to courts, law enforcement, governmental or public authorities, or other authorised third parties if and to the extent required or permitted by law. Examples include responding to a subpoena or court order, cooperating with government, insurance or regulatory investigations, enforcing our Terms and legal rights, or protecting the safety, rights, or property of our users, the public, or Scouty.

With Your Consent: Apart from the situations outlined above, we will share your personal data with third parties only if you have given us consent to do so. For instance, if we ever want to post your personal testimonial or success story on a partner's website or in a press release, we would explicitly ask for your permission.

No Selling of Personal Information: We do not sell your personal data to third parties for money. We also do not share personal data with third parties for their own direct marketing use unless you give us permission. Scouty's use of third-party advertising and analytics cookies (described above) may be considered a "share" of data under some privacy laws (like CCPA's definition of "sharing" for targeted advertising). If you are a California resident, you have the right to opt out of this kind of sharing (see "Your Rights and Choices" below for how to exercise this option).

Data Storage and Security

We understand that you trust us with your personal information, and we take steps to protect it. Except where we have mentioned in this policy, your personal information that we collect is held by us. Wherever information is not stored by us, we ensure that the security controls and local Data Privacy laws protecting this information meet the same standard as when it is stored by us and meets the requirements of the NZ Privacy Act 2020.

Here's how we handle storage and security:

Cloud-Based Storage: Your data is stored securely on cloud servers and databases managed by our infrastructure providers. These servers may be located in New Zealand, Australia, the United States, the United Kingdom, or other countries where we or our service providers maintain facilities. Regardless of location, we apply the same security standards and safeguards to your data.

Security Measures: We maintain technical and organisational measures to protect your personal data against unauthorised access, loss, misuse, or alteration. These measures include encryption of data in transit (e.g., using HTTPS for our website to encrypt information between your browser and our servers) and encryption at rest where appropriate, firewalls and intrusion detection systems, and access controls to ensure only staff who need to handle personal data can access it.

Payment Security: Any payment transactions are handled through PCI-DSS compliant providers, Scouty partners with Stripe to provide these services. We never store plaintext payment card data on our systems.

No Guarantee: While we strive to protect your information, no method of transmission over the internet or method of electronic storage is 100% secure. Therefore, we cannot guarantee absolute security. We encourage you to help protect your account by using a strong, unique password and keeping your login credentials confidential. If you have reason to believe that your interaction with us is no longer secure (for example, if you suspect your account has been compromised), please contact us immediately.

Data Retention

We will retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of providing the services, satisfying any legal, accounting, or reporting requirements, and for legitimate business purposes such as dispute resolution or fraud prevention.

In general:

Active Accounts: If you have an active account with Scouty, we will keep your information for as long as your account is active or as long as needed to provide you with the Platform services plus 36 months from closure or deletion of your account. This allows you to have a continuous history and for Coaches/Clients to retain relevant information (training history, communications, etc.).

Inactive Accounts: If you decide to delete your account or it becomes inactive for an extended period, we will initiate the process of deleting or anonymising your personal information. Typically, we consider an account inactive if there has been no login or activity for a certain period (e.g., 3 years/36 months).

Deletion Requests: If you request deletion of your data (see "Your Rights" below), we will delete or anonymise your personal data unless we are required to keep it for legal reasons. Some information may be retained in backup archives that are not readily accessible, for a brief period, before being automatically deleted.

Transaction Records: We may retain certain information after account deletion as necessary for legitimate business purposes or legal obligations. For example, we might keep payment and transaction records for accounting/tax purposes or to handle chargebacks, and we may retain logs and records related to safety, security, and legal compliance (such as consents, opt-outs, and records of communications) as required by law or to protect our rights. If data is retained for these reasons, it will be appropriately secured and isolated from routine use.

International Data Transfers

Scouty is headquartered in New Zealand, but we work with users and service providers around the world. As a result, your personal data may be transferred to and stored in countries other than your own. For example, if you are in New Zealand, some of your data might be processed in Australia, the United States or European countries where our service providers operate. If you are in the UK or EU, your data will likely be transferred to New Zealand and/or other countries (including the U.S.) in order for us to provide our services.

Transfers from the EEA/UK: The European Commission has recognised New Zealand as providing an adequate level of data protection, which means data can flow from the EEA to New Zealand freely.

Other Regions: For transfers of personal information from Australia, the United States, or any other country to a different country, this will be handled in accordance with the NZ Privacy Act 2020.

Your Acknowledgment: By using Scouty, you understand that your personal information may be transferred and stored in countries outside of your own, which may have different data protection rules. However, we will always take reasonable measures to protect your personal data as described in this Privacy Policy and operate in accordance with the NZ Privacy Act. Scouty uses cookies and similar tracking technologies to provide, personalise, and improve our Platform, as well as to display relevant advertising. This section explains our use of these technologies and your choices.

What Are Cookies? Cookies are small text files that websites store on your device to save information about you. They enable features and gather information such as remembering your login, understanding how you use the site, and personalising content. We may also use related technologies like web beacons (pixel tags), tracking URLs, local storage, and SDKs in our mobile app – for simplicity, we refer to all these as "cookies" here.

How We Use Cookies: We use cookies for several reasons:

Necessary Cookies: These are essential for the operation of our Platform. For example, they help authenticate users, prevent fraudulent use of user accounts, and enable functionality like shopping cart or payment processing. Without these cookies, the services you've asked for (such as logging in or making a purchase) cannot be provided.

Preference Cookies: These allow our site to remember choices you make (such as your preferred language or region) and provide enhanced, more personal features. They may also be used to remember your settings and preferences over time.

Analytics Cookies: We use analytics tools (like Google Analytics) that set cookies to collect information about site usage and user performance. This data helps us understand things like which pages are most popular, how users navigate through the site, and where users might be encountering errors. The information collected is generally aggregated and does not directly identify individual visitors. It helps us improve the Platform and fix issues. Advertising & Marketing Cookies: These cookies are used to deliver advertisements relevant to you and to measure the effectiveness of our marketing campaigns. They may be set by us or by our advertising partners (with our permission). For example, we use the Facebook/Meta Pixel, Google Ads cookies, and TikTok Pixel on our site. These trackers collect information about your browsing behavior on our site (and sometimes combine it with info collected on other sites) to show you targeted ads on other platforms. Marketing cookies might also limit the number of times you see the same ad and help measure ad campaign performance (e.g., whether you clicked on an ad and later signed up).

Third-Party Cookies: Some cookies on our site are placed by third parties. For example, when we embed content from third-party services or when our advertising/analytics partners set cookies. We do not have direct control over these third-party cookies. These third parties may use the information collected via their cookies in accordance with their own privacy policies. For instance, our analytics and advertising partners (Google, Meta/Facebook, TikTok, etc.) have their own privacy and cookie policies that describe how they process data.

You have several options to control or limit how cookies are used on your devices:

Browser Settings: Most web browsers allow you to refuse or delete cookies. You can set your browser to block all cookies or to alert you when cookies are being sent. Each browser is different, so check the "help" menu of your browser to learn how to change your cookie preferences. Please note that if you disable cookies entirely, our website (and others) may not function properly. For example, you may not be able to log in or use certain features that rely on cookies.

Cookie Banner & Preferences: When you first visit our site, you may see a cookie notice or banner. Where required by law, we will ask for your consent for non-essential cookies (such as analytics and advertising cookies). You can choose not to accept these cookies. If you accept and later change your mind, you can clear cookies from your browser to reset your preferences.

Opting Out of Targeted Ads: Even if you disable cookies, you might still see Scouty ads on other platforms, but they would be less tailored to you. To specifically opt out of targeted advertising, you can use tools provided by some third-party ad networks: for example, the Digital Advertising Alliance (DAA) and the Network Advertising Initiative (NAI) in the U.S. offer opt-out pages (optout.aboutads.info and optout.networkadvertising.org) for participating companies. In the EU, you can visit YourOnlineChoices.eu. These tools allow you to opt out of the use of your behavior information for interest-based advertising by participating third parties. Additionally, platforms like Google, Facebook, and TikTok allow you to adjust your ad settings on their services to control personalised ads.

Do Not Track: Our site does not currently respond to "Do Not Track" (DNT) signals. If we in the future build functionality to honor DNT signals, we will update this policy accordingly.

Your Rights and Choices

You have rights regarding your personal data, and we want you to be informed and in control of your information. Depending on your jurisdiction and the applicable laws, your rights may include the following:

Access Your Information: You have the right to request confirmation of whether we are processing personal information about you, and if so, to request a copy of that information. This allows you to understand what data we have about you. We will provide it in a commonly used electronic form.

Under the New Zealand Privacy Act 2020, you have the right to access and request correction of your personal information held by Scouty. To do so, please contact support@scouty.co.nz. If you are unsatisfied with how we handle your personal information, you may lodge a complaint with the Office of the Privacy Commissioner.

Australian Users: You can request access to or correction of your personal information as outlined above. If you have concerns about our handling of your information under the Australian Privacy Act 1988, you may also contact the Office of the Australian Information Commissioner (OAIC).

Correct/Update Your Information: If any of your personal data held by Scouty is inaccurate or incomplete, you have the right to ask us to correct or update it. You can also update some of your information directly by logging into your account (for example, editing your profile details). We appreciate it if you keep your information up to date.

Delete Your Information: You can request that we delete your personal data. This is sometimes called the "right to be forgotten." Upon your request, we will delete your information from our records, provided we do not have a valid legal reason to retain it (such as a requirement to keep records for financial reporting, legal disputes, or safety enforcement). Keep in mind that after we delete your data, backup copies may persist for a short period, but we will also delete those in the normal course of business or as noted above. Also, note that deleting your data will typically require us to cancel your account, since we cannot operate your account without processing your personal information.

Opt Out of Marketing Communications: You have a right to opt out of receiving promotional emails or text messages from us. You can do this by using the unsubscribe mechanism in the message, adjusting your settings in your account or contacting us. Please note that you will still receive transactional and service-related communications (e.g., account notifications, booking confirmations) as these are necessary for providing our services.

Complaints: You have the right to lodge a complaint about our data practices. We kindly ask that you contact us first at support@Scouty.co.nz so we can address your concerns. However, if you are in the European Union/UK, you have the right to file a complaint with your local Data Protection Authority. If you are in New Zealand, you can contact the New Zealand Privacy Commissioner. Australian residents can reach out to the Office of the Australian Information Commissioner (OAIC). California residents can contact the California Attorney General's Office or the California Privacy Protection Agency regarding CCPA concerns. We will cooperate with regulators and work to resolve any issues.

California Privacy Rights: If you are a California resident, you are entitled to specific rights under the CCPA (as amended by the CPRA) in addition to the general rights above. These include: (i) the right to know the categories of personal information we have collected about you, the categories of sources, the business or commercial purpose for collecting it, and the categories of third parties with whom we share it; (ii) the right to access the specific pieces of personal information we have collected about you (you can request this through an access request as described above); (iii) the right to request deletion of your personal information (subject to certain exceptions as described above); (iv) the right to opt out of the "sale" or "sharing" of your personal information for interest-based advertising purposes. Scouty does not sell personal information for money; however, we may share identifiers and data with advertising partners to deliver personalised ads, communications and services, which is considered "sharing" under CCPA. You can opt out of this by using the cookie and advertising opt-out methods described in the Cookies section and (v) the right not to receive discriminatory treatment for exercising any of your CCPA rights. If you need to exercise your California privacy rights, please contact us at support@scouty.co.nz and detail your request. We will verify your identity and respond as required by law.

Exercising Your Rights: To exercise any of your rights, please contact us at support@scouty.co.nz. Describe your request with sufficient detail that allows us to properly understand and respond. We may need to verify your identity before fulfilling certain requests (for instance, by confirming you have access to the email associated with your account or asking for additional information). We will respond to your request within the timeframe required by law (generally within one month for GDPR requests, and within 45 days for CCPA requests, with the possibility of a reasonable extension). There is no charge for making a request, though in rare cases we may charge a reasonable fee or decline to act on requests that are manifestly unfounded or excessive.

Third-Party Links and Services

The Scouty Platform may contain links to websites or services that are not operated by us, such as a Coach's personal website, articles, or social media pages. If you click on a third-party link, you will be directed to that third party's site. Remember that this Privacy Policy does not apply to third-party websites or services. We encourage you to review the privacy policies of any third-party site or service that you visit or use.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. If we make material changes, we will notify you by posting the updated policy on our website and changing the "Last updated" date at the top, it is Clients and Coaches responsibility to regularly check this. In some cases, we might provide additional notice (such as by emailing you or displaying a prominent announcement on the Platform) especially if required by law. We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your information. Your continued use of Scouty after any changes to this Privacy Policy means you accept the updated terms.
